Price:

Prices are firm for the validity period of the quotation. However, we reserve the right to re quote should, 
in our opinion, changes in exchange rate, taxes, government regulations etc. materially affect our ability 
to deliver the product at the originally quoted price. Quotations may be revised or amended to correct 
material errors or omissions.
Unless otherwise agreed in writing by us, all prices quoted are exclusive of value added tax (VAT) but 
inclusive of current import duties. Any changes in duty or taxes imposed after date of quotation or after 
receipt of buyers order, whichever occurs first, will be for the buyers account. Onus is on buyer to provide 
A&V Technologies cc with valid customs documents at the time buyer places an order, if buyer is eligible for 
duty or tax rebates.

Guarantee:

In lieu of any condition or warranty expressed or implied by law or otherwise, A&V Technologies expressly 
guarantee at their option to repair or replace any part of products delivered by them which, within a period 
not exceeding twelve (12) months from date of delivery, may prove defective through bad material or workmanship, 
fair wear and tear excluded.
In no event shall we be liable for direct, indirect, special, incidental or consequential damages 
(including loss of profits) whether based on contract, tort or any other legal theory.

Software warrantee:

A&V Technologies cc warrants the magnetic diskettes and CD’s upon which software is furnished, but not the 
software itself, to be free from defects in material or workmanship for a period of ninety (90) days from the 
date of purchase. Our obligation under the diskette or CD warrantee shall be limited to the repair or replacement 
of defective diskettes or CD’s during the ninety (90) days period. Defective hardware or defective diskettes and 
CD’s shall be returned prepaid to A&V Technologies cc for service. A&V Technologies cc reserves the right in its 
sole discretion whether to repair or replace defective parts, diskettes, CD’s or products. A&V Technologies cc 
makes no warrantee, expressed or implied, with respect to software, and it is sold “as is”.
The sale is made on the express understanding that there is no implied warrantee that the software shall be 
merchantable and no implied warrantee that the software shall be fit for any particular purpose. By use of the 
software the purchaser acknowledges that he/she is not relying on A&V Technologies cc’s skill or judgement to 
select or furnish products suitable for any purpose and that there are no warranties on software that extend 
beyond the description hereof.
In no event shall A&V Technologies cc be liable for direct, indirect, special, incidental or consequential 
damages (including loss of profits) whether base on contract, tort, or any other legal theory.

Commissioning and installation:

Prices are exclusive of commissioning and installation.

Shipment, Title and Risk of Loss:

Title to and ownership of the products shall pass to the buyer upon payment in full. Risk of loss and damage 
shall pass to the buyer on delivery of the products either to the buyer or a common carrier at the specified 
delivery point.

Delivery:

Delivery promises are given in good faith and every effort will be made to adhere thereto, but A&V Technologies cc 
shall not be held responsible for delays beyond our control.

Payment:

All invoices are payable within 30 days of Goods delivered, interest at 2% per month will be charged on overdue 
accounts. Payment shall be made in full and shall not be withheld or reduced for any reason whatsoever unless our 
prior written consent has been obtained. Where partial delivery has been made, payment shall be made in full, in 
accordance with the above terms for products delivered.
